Guide

What are the requirements to file the Petition for Alien Fiance (e)?

• You must be a U.S. citizen
• You and your fiancé (fiancée) are both free to marry, which means that both of you are unmarried, and your previous marriages, if you had any, have ended in divorce, death, or annulment
• You and your fiancé (fiancée) both have a serious intention to marry within 90 days of your fiancé (fiancée) entering the United States
• You and your fiancé (fiancée) must have met in person within the past two years unless:
- It would violate strict and long-established customs of your or your fiancé (fiancée)'s foreign culture or social practice to meet before marriage (very few people qualify for this exception); or
- It is established that the requirement to personally meet your fiancé (fiancée) would result in extreme hardship to you, which means something very close to "impossible". It generally is available only to people who are so disabled that they can't fly at all.
• You have to meet certain income requirements
